These General Conditions of Sale have as their object the regulation of the purchase of products and services, carried out remotely and made available, via the internet, from the website www.marchiartlab.com.
We try in every way to satisfy our customers by offering a high quality product.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The sales contracts of the Works published on the site (Distance contracts and / or Contracts negotiated outside the business premises), are considered concluded when the Order placed by the Buyer reaches the Seller, and the latter accepts it. , by sending the Order Confirmation.
The Order may be sent to the Seller through the appropriate section of the Site.
By sending the Order online, the Buyer sends the Seller a purchase proposal for the Works included in the cart.
When the Buyer places an online Order, he agrees to purchase the Works included in the cart at the price and terms indicated in these General Conditions.
The Seller will promptly notify the Buyer of the acceptance of the Order by sending the Order Confirmation.
The Seller will send the order as soon as it has received the payment through the various channels available.
The Seller, in particular, may not accept the Order if the chosen Work is no longer available or there is no agreement on the payment method, or for any other impediment relating to the execution of the Order.
The offers on the Site are considered valid as long as the Works remain published online. The Seller reserves the right to notify the Buyer within 7 (seven) calendar days of purchase, to the email address associated with his profile, of any unavailability of one or more purchased Works. In the event of the purchase of Works that are no longer available, the Seller will refund the purchase price, using the same payment method used by the Buyer for the refund. In the case of multiple Orders, the unavailability of one or more Works will not entitle the Buyer to cancel the Order in its entirety.
By sending the Order, the Purchaser declares to have read and accepted these General Conditions.
The Buyer is required, before sending the Order, to carefully read these General Conditions. The forwarding of the Order implies their full knowledge and their full acceptance.

PRICES
The prices indicated are expressed in EURO and include VAT for the Member States of the European Union.

ORDERS
All payments are made in EURO and include VAT for EU member states.
No other amount will be due at the time of delivery. When ordering, please check the accuracy of the data and the delivery address. In case of errors, please notify us promptly at marchiartlab@gmail.com

SHIPMENTS AND DELIVERIES
Our shipments are made with courier service or depending on availability, we could deliver them to you personally with our means.
Shipping costs:
Shipments in Italy are free for every order in the ArtStore, while for orders of works on request the shipment will be agreed with the customer from time to time.
Shipments to the European Union (*) cost from 30 to 60 Euros for each order in the Art Store, while for orders of works on request it will be agreed with the customer from time to time.
The countries of the Europa_extraEU (**) list have a shipping cost of 75 Euros for the works in the ArtStore, while the shipping will be agreed with the customer for the works on request.
Shipments in the World (***) both ArtStore and on request, are agreed with customers from time to time.

Delivery times depend exclusively on the times declared by the carrier and are generally 4-15 days for shipments to Italy and European Union countries; 7 or more days for non-EU countries for reasons related to the issue of export documents due to the competent offices and which do not depend directly on us. *

The customer is required to verify that the products received correspond to those of the order placed.

If the delivered products show defects, the customer must contact Marchi Art Lab no later than 48 hours from delivery, by sending an email with a photo of the defects found to the following address

(*) Countries for which shipping outside the Italian territory are part of the EU: Austria, Belgium, Croatia, Denmark, Finland, France, Germany, Greece, Ireland, Luxembourg, Holland, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Spain, Sweden and Hungary.
(**) Europe_extraEU list: Liechtenstein, Norway, Principality of Monaco, United Kingdom, Switzerland.
(***) Countries of the world for which agreed shipment is foreseen: Saudi Arabia, Australia, Canada, South Korea, United Arab Emirates, Japan, Mexico, New Zealand, Principality of Monaco, Qatar, United Kingdom, Russia, United States and Switzerland and all EU countries not included in the first list
* We inform our customers Europe_extraEU and Rest of the World that the practices pertaining to public offices can be very long and those not processed, result in a refund of 100% of the total paid.

PAYMENTS AND SECURITY
Marchi Art Lab accepts payments in Euros.
The following payment methods are accepted:
* Credit Card: we accept credit cards belonging to the Visa and MasterCard circuits
* PayPal
*Bank transfer
* ApplePay
All transactions made by credit card take place through the respective gateways.
No data relating to these types of payment is recorded by Marchi Art Lab
We also accept credit cards enabled for the 3-D secure service, for the use of which an additional PIN will be required.
Furthermore, Marchi Art Lab uses a security certificate with a 1024 bit SSL encrypted connection to further strengthen the security standards. Any attempted fraud will be identified and reported to the local competent authorities.

RETURNS AND REFUNDS
Pursuant to art. 52 of the legislative decree 6 September 2005 n. 206 ("Consumer Code"), you have the right to withdraw from the purchase contract without any penalty and without giving any reason, within fourteen (14) days from the day you received the products purchased on www.marchiartlab.com.
Following the return of the Work, the Seller will carry out the necessary checks on its compliance with the conditions and terms indicated in these General Conditions. In the event that the checks are concluded positively, the Seller will send the Buyer (by e-mail) the relative confirmation of the acceptance of the Work thus returned. The Seller will have the right not to accept the return of the Works that have been altered and / or damaged.
The reimbursement will be paid by the Seller within 14 days from the date on which the latter becomes aware of the exercise of the right of withdrawal. The Seller may withhold the reimbursement until he has received the Works or until the Buyer has demonstrated that he has returned them, whichever occurs first, pursuant to art. 56 of the Consumer Code.
Brands Art Lab guarantees 100% refund, with the exception of any local duties and taxes.
All products without packaging, or with damaged packaging, used or incomplete will not be refunded.
The customer must communicate his desire to withdraw from the purchase by registered letter with return receipt to the address:

Marchi Art Lab reserves the right to refuse unauthorized returns and return them to the sender.

EXPRESS TERMINATION CLAUSE
​
In the event of total or partial non-payment of the purchase price of the Work, in the manner and terms agreed, the Seller reserves the right to declare the sales contract terminated, pursuant to and for the purposes of art. 1456 cc, by sending a written communication to the Buyer's address.
CUSTOMER SERVICE AND TERMS OF TERMINATION OF THE CONTRACT

The Seller will take care to keep a copy of the General Conditions in force at the time the Order is sent and the Order Confirmation. Should the Buyer find errors or inaccuracies in the data provided to the Seller, he must promptly notify Customer Service.

WARRANTY AND CONFORMITY

In case of problems, the customer undertakes to contact Marchi Art Lab directly by sending an e-mail with a photographic description of the problem to the following address: marchiartlab@gmail.com .
This warranty applies only to the original purchaser and does not cover damage due to normal wear and tear, accident, abuse, or normal loss of color and wear of materials.
The images and colors of the articles on the site may not fully correspond to the real colors due to the type of computer screen or browser used for navigation.
Marchi Art Lab reserves the right to charge the customer for all costs incurred for the verification of the product and for the shipment of the same, if it is intact and functioning or without the lack of conformity complained of and referable to the date of delivery.

APPLICABLE LAW
​
The purchase contract between the customer and Marchi Art Lab is to be considered concluded in Italy and is therefore governed by Italian law and by the community legislation that regulates remote purchases. In the event of any dispute, the competent court will be the Court of Florence.
